Family Law

Going through a divorce or custody dispute may be one of the most difficult experiences of your entire life. In addition to the stress and change that typically come with a family law action, you may also find yourself in contact with the court system, perhaps for the first time ever. At Nierengarten & Hippert, our attorneys all have years of family law experience. We will provide you with effective and ethical representation. We have guided our clients through many trials, hearings, and meditations. We will fight for you through all stages of the process, from the filing of papers through the final order and beyond. We will assist you in dealing with all of the different people you come in contact with through the process, including court staff, social workers, child support officers, custody evaluators, and appraisers for the valuation of your assets. Even if you and the other party can come to a general agreement on your own, a lawyer’s trained eye can spot and help prevent potential future headaches. We will protect your rights, stand up for you in court, and do everything we can to get you through this as painlessly as possible.

Family LawThe types of cases we handle include

  • Divorce/Dissolution. A divorce can be a painful and stressful process. We will help you with all the issues that come up in a divorce, including child custody and parenting time, child support, division of assets and liabilities, alimony/maintenance, what to do with any real property and related mortgages, tax issues, and all other challenges that a divorce provides.
  • Modification of custody, visitation, parenting time. Perhaps you already have a custody and visitation order in place. For a variety of reasons, this order may need to be changed, or perhaps the other parent is seeking to change an order and you want it to remain the way it is. The lawyers at Nierengarten & Hippert can assist you through this process.
  • Establishment of paternity and child custody. If you have a child outside of marriage, the law presumes that the mother has sole custody until a court order establishes parental rights. Obtaining such an order can eliminate uncertainty and ensure that both parents’ rights are protected and that the child’s best interests are taken into account. We can work for you on all issues that come with an action to establish custody and parenting time, including establishing paternity, establishing a custody order and parenting time schedule that is best for the child, and ensuring that there is a fair child support order.
  • Modification of child support. You have an existing child support order, but circumstances have changed, perhaps because of job changes or layoffs, and the existing order is no longer fair. Do not expect that telling the child support office about the change will protect you and your child. The child support office can and does sometimes take months to get back to court. In the meantime, you could run up a large bill of back child support, or you could go months without receiving all the support to which you are entitled. A lawyer can get your support order changed much faster to ensure that the child support remains fair to all and that the child is properly supported.
  • Domestic abuse, order for protection, harassment restraining order. If you need a court order to stop a person from harassing or abusing you or your child, or if you have been served with an order preventing you from having contact with a certain person or people, our attorneys can represent you and protect your rights.

We also handle the following types of cases

  • Adoption, including adoption by step-parent
  • Child in need of protection (CHIPs) proceedings
  • Termination of parental rights
  • Alimony/maintenance modification

Whether you have been served with papers or you need to start a family law proceeding, the attorneys at Nierengarten & Hippert are there for you at this time of transition in your life.
